1. BASIC CONCEPTS
1.1 User – a legal entity or an individual using the services of the Portal (applicant, employer).
1.2 Portal – work-in.lt portal belongs to MB “StSolutions”, legal entity code 306097411, VAT code LT, e-mail address info@work-in.lt
1.3 Agreement is an agreement to use the Portal for Registered Employers and Job Seekers
1.4 Personal data – any information relating to a natural person whose identity is known or can be directly or indirectly established using data such as name, surname, telephone number, e-mail address, etc.
1.5 Data Recipient – a natural or legal person who uses the Portal to find or select employees for their own needs or the needs of their clients, as well as a natural person who uses the Portal for job search purposes. The Portal transfers or provides Personal Data to these persons in accordance with this Agreement.
2. GENERAL CONDITIONS
2.1 The site is a purely technical solution through which job seekers can publish their resumes or job advertisements, and employers their job offer, through which job seekers can apply for the job offered. On the portal, the User can search, post, view published job offers. work, as well as view and upload resumes, use other services available on the portal.
2.2 Job advertisements and resumes are considered as an offer on behalf of the User who posted them, but not on behalf of the portal. The portal only provides technical possibilities for the publication of vacancy announcements and resumes, but is not responsible for their content and correctness.
2.3 The User is responsible for the consequences and obligations arising from their information posted on his behalf on the Portal.
2.4 The Portal is not responsible for any promises given to the Data Recipient by the User, does not participate in negotiations between the job seeker and the person offering the job, and is not an intermediary in concluding an employment contract, is not a party to such an agreement and is not responsible for its execution.
2.5 The User agrees that the Portal has the right to use advertising information for the purpose of advertising the Portal. The User agrees that his advertising and other content presented on the User Portal, including any intellectual property, will become part of the Portal, and will also be protected by the Portal owner and / or its authorized persons and used for an unlimited period of time and in ways established by law, unless otherwise provided by this Agreement. Neither the owner of the Portal nor any other third party using advertisements and/or other content published by the User will be obliged to pay the User royalties or other remuneration for the use of such content.
3. RIGHTS AND OBLIGATIONS OF THE USER
3.1 The Portal can be used by both registered and unregistered Users. Some Services are available only to registered Users. Registration of the User (hereinafter – Registration) is carried out by entering their data (hereinafter – Login Data) in the Registration form on the Portal. Registration instructions are provided on the registration form.
3.2 Each User undertakes:
• indicate the name, surname of the contact person, correct e-mail address, postal address, telephone number, other contact information, if necessary for the use of the Portal and/or Services, including for Registration on the Portal;
• not to use data of contact fictitious persons;
• not to use the Portal and/or the Services to perform illegal activities or transactions or to commit fraud, and not to perform activities that may harm any person, their property or legitimate interests;
• not to use the Portal and/or any of its content (Advertising, other information) for the implementation and development of activities that compete with the Portal and/or the owner of the Portal, including advertising that mentions third parties that directly or indirectly compete with the owner of the Portal or products of such persons and/or services, as well as links to such persons and/or their products. Competitors of the portal owner are any persons who create, develop, manage or administer websites related to job postings, as well as persons associated with such direct competitors. The portal owner has the right to indicate to the user its competitors (including the user himself), and such persons will be considered competitors of the portal owner within the meaning of this provision;
• provide objective, correct, comprehensive and detailed information about your offers (ie the information provided must correctly describe the job offers, their conditions, etc.);
• make sure that all information provided by the User, including Advertising ads: not misleading, offensive, deceptive or unfair, and not contrary to public order or good morals; does not violate the requirements of legal acts (including legal acts regulating the rights of employees, advertising or competition), as well as property or personal rights of third parties; does not contain viruses or others or files that can disrupt the normal functioning of the Portal, cause damage to other Users or their property, limit the ability of the owner of the Portal to properly provide the Services and/or the ability of other persons to use the Portal and/or the Services;
• not collect, accumulate, transfer to other media, make public, publish or distribute data about users of the Portal or data on any actions of users of the Portal, including data on offered and/or sought vacancies related to their conditions, etc.;
• do not copy the contents of the Portal (unless permitted by the Rules and/or services/products offered on the Portal), do not remove authors or trademarks from any copies of the contents of the Portal, do not create an electronic or manually restored database based on the contents of the Portal, do not post the content of the Portal on other websites, as well as not to change the content of the document downloaded from the Portal;
• not use any automated means, including, but not limited to, additional computer equipment and/or software, to view and/or save data, create and edit Advertisements and other information on the Portal, and not use any means processing the content of the Portal and (or) design, and (or) Services (including the placement of Advertisements), copy, decompile, encrypt, reprogram, transfer, redirect in a manner other than that permitted by the standard functionality of the Portal, if the use of the Portal is otherwise and (or) the Services are not agreed in advance with the User in writing;
3.3 The registered user also undertakes:
• provide true and complete information about yourself. Registration using third-party data is prohibited;
• store the login data, in case of their change, update them in a timely manner, do not transfer them to unauthorized third parties, immediately notify the owner of the Portal about the loss of such data. The User is responsible for any actions of third parties if they were committed using the User’s login data, and all consequences arising from this fall on the User;
• immediately notify the owner of the Portal of possible unauthorized disclosure or unauthorized use of login data. The Portal Owner will try to prevent further illegal use of the Login Data, but does not assume responsibility for damage, loss or inconvenience incurred by the User or third parties caused by the disclosure, theft or illegal use of the Login. Data;
3.4 The User agrees that the data provided by him on the Portal after Registration will be available to other Users and that the owner of the Portal is not responsible for the use of such data.
3.5 By using any Service, the User confirms that he:
• is a capable individual with all the powers and rights to provide Announcements and perform transactions related to Announcements;
• will properly perform its duties specified in the Rules;
• understands and agrees that from the moment the User accepts these Rules, only such legal relations arise between the User and the owner of the Portal that are directly and clearly provided for by these Rules;
• understands and agrees that if the Login Data becomes known to third parties, such third parties may assume obligations that will become binding on the User, and undertake to assume and duly fulfill such obligations, and the Portal Owner does not bear any obligations in any way other than verification of the Registration Data to verify the identity of the User, as well as the fact that the owner of the Portal will not be liable for damage caused to the User and / or third parties due to the fact that the User has provided incorrect and /or incomplete data or did not change or supplement the data when they were changed;
• understands and agrees that the owner of the Portal processes and manages the User’s personal data in accordance with the laws and regulations of the Republic of Lithuania;
3.6 For Applicants:
• By registering on the Portal, as well as using the Portal to search for job offers and/or offer your candidacy to employers, you agree that the data you provide related to job search will be visible or partially visible to registered Users of the Portal who are looking for employees .
• You have the option to delete your data e or make them unavailable to employers by selecting the appropriate status on your resume. You can also edit, supplement and delete your data at any time.
• You accept responsibility for the information provided, which must be true, and agree to be liable for damages and losses that may result from the provision of false information.
• Your data will not be transferred to parties not related to the provision of the Portal’s services.
• In order to provide employers with only correct and clear information, your data may be verified by representatives of the owner of the Portal before it is provided to employers.
• The owner of the portal has the right to collect, store, edit, process and transfer the data provided to employers and use them for the needs of employers related to the search for employees. The portal owner has the right to delete inaccurate or incorrectly filled data, as well as delete your resume in connection with your illegal actions in relation to employers, the system or persons associated with the provision of the Services, as a result of which these persons may suffer material or non-material damage.
• The owner of the portal is not responsible for any damage that may arise as a result of offers, promises or other actions related to the employment of companies that are registered on the portal and are looking for employees.
• The owner of the portal is not obligated to employ you, job offers on the portal are provided by third parties, that is, employers using the services of the portal.
3.7 For employers:
• By registering on the Portal, and by using the Portal to submit job offers and/or job offers, you, as an employer or their representative, confirm that you have the authority to represent the company and agree to these Rules, and that the company details specified in your registration form are correct, accurate and detailed.
• The registered company becomes the controller of its login details. The company itself ensures the security of its login data and is fully responsible for the actions of persons logging in on its behalf.
• After registering the company, you will be able to receive commercial and other offers from the owner of the portal. You have the right to refuse to receive such offers by notifying the owner of the Portal.
• You must place advertisements in accordance with the procedure set forth in the Rules and/or the Advertisement Form and/or elsewhere on the Portal. By placing an Advertisement, you assume full responsibility for the compliance of its content with the terms and conditions of the Rules and legal acts of the Republic of Lithuania. By providing data in an ad, you represent and warrant that the information provided is true, accurate and complete.
• When placing an Announcement, as well as when editing, updating, etc. it is necessary to publish them in thematic sections corresponding to their content, not to write the text in the published Announcement in capital letters, not to publish meaningless Announcements or Announcements with meaningless sequences of characters and (or) words.
• When placing ads or using the database of the Portal, it is necessary to provide candidates with reliable information about the proposed vacancy, including information about the company’s own activities, the content of the position, requirements for candidates, proposals for candidates, contact information.
• The Equal Opportunities Act prohibits giving preference to candidates in job advertisements or discriminating against them on the various grounds of discrimination specified in the Equal Opportunities Act (sex, race, nationality, language, origin, social status, faith, beliefs or opinions, age , gender). orientation, disability, nationality, religion), so you agree to post only Ads that do not violate this law.
• It is prohibited to publish Announcements on the Portal that are contrary to the laws of the Republic of Lithuania, as well as job advertisements of an erotic nature or otherwise contrary to established moral standards.
• Only one ad may be posted per job offer. When placing two or more similar Announcements, their descriptions must clearly show how the offered vacancies differ from each other. It is forbidden to use one Advertisement to search for 2 (two) or more different positions. It is forbidden to change positions during the term of the Announcement. Corrections in the title of the position are allowed only if the duties of the employee in demand after the corrections are made do not change significantly. When distributing an invalid (posted more than 30 days ago) announcement, changing the title of the position is not limited.
• If employees are looking for the same position in different cities, proposals for each city must be published
ana in separate Announcements. The ad only lists the city in which the vacancy is located.
• When entering the Announcement, you must enter a contact e-mail and phone number only in a special field. It is forbidden to indicate in the Announcement any other method of filing an application, except for filing through the Portal system. It is forbidden to indicate contact details in fields not intended for this purpose. Applications are accepted by clicking the “Save CV” button at the bottom of each ad.
• Services for the employer are paid. Fill out the forms on the site You can independently order and pay for any service presented on the portal. After purchasing the service and confirming the payment made, announcements will be published or access to the service will be activated.
• You may use the portal only for the purpose of recruiting employees for your company or its branch. You must use the received personal data of candidates, without violating the laws of the Republic of Lithuania, solely for the purpose of recruiting candidates. It is forbidden to provide information about candidates received on the Portal to third parties without the separate permission of the owner of the Portal, except as otherwise provided by law.
• You undertake to reimburse the damage caused through your fault to the owner of the Portal or Users.
3.8 The user who violates these conditions, depending on the nature and consequences of such a violation, bears civil, administrative or criminal procedural liability established by the regulatory legal acts of the Republic of Lithuania
4. RIGHTS AND OBLIGATIONS OF THE PORTAL
4.1 The Portal provides the User with a platform for registering and publishing vacancies or CVs.
4.2 The Portal undertakes to provide quality services offered on the Portal. If the service is paid, then after purchasing the service and confirming the payment made, the Portal undertakes to publish announcements or activate access to the service.
4.3 The Portal processes Personal Data (generalizes, stores, sorts, distributes, combines, uses, destroys, etc.) in order to deliver them to Data Recipients.
4.4 If there is reason to believe that the entered personal data, company information or the content of the job offer are fictitious, incorrect, erroneous or do not comply with applicable ethical standards, the Portal has the right to remove such data, advertising and / or profiles without warning and restrict access to Portal for an unlimited period of time.
4.5 The Portal is not responsible for the damage that the User may incur when searching for persons for vacant jobs and using the services of the Portal for this purpose.
4.6 The Portal does not guarantee that the User will find a job or a suitable employee using the Portal or that persons looking for a job or employee will contact the User.
4.7 If there is reason to believe that the entered personal data or resume (CV) is incorrect or does not comply with applicable ethical standards, the portal has the right to delete such data without warning.
4.8 The Portal is not liable for any damage that the User may incur when looking for a job or participating in job contests and using the Portal’s services for this purpose.
4.9 The Portal is not responsible for the misuse of the data provided to the Data Recipient, as well as for compliance with data confidentiality obligations on the part of the Data Recipient.
5. PERSONAL DATA
5.1 The Portal collects the personal data of the User, which he voluntarily provides after registering on the Portal (registration of an employer or job seeker account) or using other services provided by the Portal, in order to transfer the collected data to Data Recipients.
5.2 Taking care of the User’s confidentiality and trust, the Portal undertakes to protect the confidentiality of the User’s personal data and use the information provided solely for the purposes specified in this Agreement, without the User’s consent not to disclose this information to any third parties, except as provided by the Agreement, related to the provision of direct services to the User. The Portal may also transfer the User’s Personal Data to third parties who act as data processors on behalf of the Portal. Personal data can only be provided to those data processors with whom the Portal has signed relevant agreements or cooperation agreements that contain provisions regarding the transfer / provision of personal data, and the data processor ensures adequate protection of the transferred personal data. It is considered that the User is notified about it, agrees with it and the Portal is not responsible for the damage resulting from the use of the User’s data by third parties, to the extent permitted by the relevant laws. In all other cases, the User’s personal data may be disclosed to third parties only in the manner prescribed by legal acts of the Republic of Lithuania. The portal may transfer the user’s personal data to state or law enforcement agencies at their request and only in cases provided for by applicable law.
5.3 Purposes of using the User’s Personal Data:
• Share data with individuals seeking employment for employment purposes;
• Transfer of data to company representatives for recruitment purposes;
• To process and administer the purchase (order) of user services;
• To identify the User in the information systems of the Portal;
• To identify the user when logging into his account on the Portal;
• for issuing financial documents of ordered services;
• Solving problems related to the provision and use of services; to communicate with the User;
• for direct marketing purposes;
• statistical analysis, general research to improve services and improve their quality;
5.4 The Portal collects information about the User: name, surname, position, e-mail address, telephone number, city in which the person works. When providing personal data, the User:
• grants the owner of the Portal the right to dispose and process his Personal Data for the purposes stipulated by these rules. The User has the right to revoke the permission of the owner of the Portal to manage and process his Personal Data.
• The User declares that he provides his personal data for placement on the Portal at his own request and agrees that the data provided by him will be stored and processed electronically in the Portal database for 3 (three) years from the date of his last connection to the system and after this period will be destroyed by a person authorized by the owner of the Portal;
• The User agrees and confirms that he provides his contact details (name, surname, phone number, e-mail address, etc.) on the Portal so that Data Recipients can access, view and copy this data (when the data is presented in advertisements as contacts).
5.5 By granting the right to process data for direct marketing purposes, the User also grants permission to contact him by phone, SMS, e-mail, newsletters with direct marketing offers.
5.6 When the User registers and connects to the system, the system records the IP address of the User’s computer, as well as the date and time of connection to the system.
5.7 The Portal Owner does not provide personal data, the User does not confirm his identity, requests data about another person, as well as in other cases provided for by law that restrict the disclosure of data.
5.8 The employees of the Portal, in the performance of their duties and the processing of the Personal Data of the User’s contact persons, adhere to the following principles:
• The information provided by the user is collected, processed and stored only for legitimate interests and in strict accordance with the requirements of the Law on the Legal Protection of Personal Data of the Republic of Lithuania, the Civil Code of the Republic of Lithuania, and other legal acts. laws governing this area in the Republic of Lithuania and this Agreement.
• The personal data of the user’s contact persons are collected for certain purposes.
• When collecting and processing Personal Data, the principles of expediency and proportionality are observed, while the User is not obliged to provide data that is not needed and is not collected.
• Collects only the data that is necessary to provide quality services, including consulting on the Portal’s services.
• Access to the Personal Data of the user’s contact persons can only be obtained by employees of the Portal with the appropriate competence and / or third parties that the Portal used to provide the service, and only in cases when it is necessary for the provision of the service.
5.9 The User has the opportunity to subscribe to the Portal’s newsletters and messages sent for the following purposes:
• Inform the User about new or potential candidates or vacancies;
• Inform about changes, new features or services on the Portal;
• Periodically remind the User to update their contact Personal Data or information in advertisements.
5.10 The Portal provides the User with the opportunity to refuse the information sent by the Portal in the newsletter or other letter by clicking on the provided link to refuse the offer or by contacting the Portal administration by phone or e-mail in the Portal contacts.
5.11 To cancel all personal data stored on the portal, the user can:
• By using the “Delete Account” feature on your own and deleting your account and all information about yourself associated with it. The data is deleted immediately.
• Write a letter to info@work-in.lt with a request to delete your account and personal data. Once we verify that the account is indeed owned

6. PAID SERVICES
6.1 The use of the Site is subject to a fee for the User if it is specified in the Terms of Use.
6.2 In the case of paid services, the obligation of the User to pay arises from the moment of ordering the Service. The user is obliged to pay Service in full. Services can be paid by bank transfer, credit card or other specified method. You can choose payment method when ordering a service. Paid services are connected and
provided only after payment. Payment must be made within 3 (days) days from the date of occurrence payment obligation. The user bears all costs associated
with payment of bills and commission for services. The invoice is considered paid in the moment of receipt of funds to the MB current account STSolutions.
6.3 The Portal has the right at any time to unilaterally change the amount of payment for any paid services and the payment procedure, which will be previously reported on the Portal website.
6.4 After payment of the invoice to the User to the specified email address A VAT invoice will be sent by mail.
6.5 In case of late receipt by the User of paid services, except in cases of violation of the rules of use of the Portal, the Portal, at the request of the User, undertakes to extend provision of paid services to the User for a period during which paid services were not provided.
6.6 The Portal has the right to limit or terminate the provision of services on up to 3 hours during the maintenance period. A user using paid services will
informed about the start of preventive work by e-mail mail and/or other notice, no later than 1 (one) hour before start of work. In this case, the Portal may, but is not obliged to, extend provision of paid services to the User for the period during which paid services were not provided.
6.7 The conditions for the return of money are set out in the section “Refund policy”.

• Analytical cookies: The Portal uses this type of cookie to understand how the Portal’s visitors use the Portal, to identify the website’s strengths and weaknesses, to optimize and improve the website’s performance, and to further implement advanced solutions. The collected data includes pages viewed by the User, the type of platform used by the User, date and time information, number of clicks, mouse movements and browsing activity, keywords and other text that the User collects when browsing the website. The Portal also uses analytical cookies for online advertising companies to analyze the behavior of Users after they have been shown online advertisements of the Portal. 8. FINAL PROVISIONS
8.1 The laws of the Republic of Lithuania apply to the Rules.
8.2 All disagreements arising between the owner of the Portal and the user regarding the implementation of these Rules are resolved through negotiations. User – the user must first submit an application and / or complaint regarding the activities and services of the Portal in writing to the owner of the Portal and indicate their requirements. If the parties do not resolve the dispute through negotiations, such dispute shall be subject to final resolution in court in accordance with the procedure established by the legislation of the Republic of Lithuania.
8.3 When the User visits the Portal and provides personal information about his contact persons, it is considered that the User has read and agrees to this Agreement.
